AllStarLink Terms of Use

Please read these terms carefully. By using any AllStarLink service, you agree to these Terms of Use.

1. Introduction and Acceptance

AllStarLink, Inc. (“AllStarLink,” “we,” or “us”) is a non-profit amateur radio organization based in Florida, United States. These Terms of Use (“Terms”) govern your access to and use of all AllStarLink Services, as defined below.

By accessing or using any AllStarLink Service, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you register for an account, you will also be asked to confirm your agreement during registration. If you do not agree, you may not use the AllStarLink Services.

2. Definitions

  • “AllStarLink Services” means all websites, software distributions, network infrastructure, and services operated by AllStarLink, including:
    • the websites at allstarlink.org and allstarlink.net and their subdomains, including the AllStarLink Portal;
    • the AllStarLink network infrastructure, including node registration, authentication, lookup, and directory services and their associated APIs;
    • stats.allstarlink.org and published node lists;
    • systems that allow third-party applications to access the AllStarLink network, and other tools provided through the websites;
    • the community forum at community.allstarlink.org and mailing lists at lists.allstarlink.org;
    • the Helpdesk at helpdesk.allstarlink.org;
    • the documentation at allstarlink.github.io; and
    • donation services offered on our websites.
  • “Account” means a registered AllStarLink user account.
  • “Callsign” means an amateur radio callsign issued by a governmental licensing authority.
  • “Node” means a station, server, or application registered with or connected to the AllStarLink network, and “Node Number” means the number AllStarLink assigns to identify it.
  • “User Content” means anything you post, submit, or transmit through the AllStarLink Services, including forum posts, messages, and information about your Nodes.

3. Eligibility and Accounts

Anyone may view our public websites and documentation. To register an Account, you must:

  • hold a current amateur radio license issued by a national licensing authority, such as the U.S. FCC or the U.K. Ofcom;
  • be at least 13 years of age (see the Children's Privacy section of our Privacy Policy);
  • provide accurate, complete, and current information that matches your license, and keep it up to date; and
  • register only one Account per Callsign. Accounts for club station Callsigns must be held by the station trustee.

Your Account username is your Callsign. You are responsible for keeping your password confidential and for all activity under your Account. You may not share your Account, use another person's Callsign, or impersonate anyone. Notify us promptly at helpdesk@allstarlink.org of any unauthorized use of your Account or any security breach.

Use of your verified Callsign. AllStarLink verifies each Account's Callsign against the license submitted at registration. You are expected to register for, use, and post on all AllStarLink Services, including the community forum, mailing lists, and Helpdesk, under that verified Callsign. You may not use an unverified, altered, or anonymous identity in its place. If your Callsign changes, you must submit a Change Callsign Request rather than registering a new Account.

Unlicensed participants. The community forum is open to participants who do not hold an amateur radio license. Unlicensed participants must set the forum's Callsign field to “NONE” and use their real first and last name as their display name. Anyone who holds a license is expected to enter their Callsign in that field, even if they have not registered an AllStarLink Account. AllStarLink administrators may question participants whose Callsign field is set to NONE, may ask them to confirm that they are not licensed, and may restrict or suspend forum access if these requirements are not followed.

4. Amateur Radio Compliance

AllStarLink links licensed amateur radio stations. You are solely responsible for ensuring that your use of the AllStarLink Services, and everything transmitted through your Nodes, complies with the rules of your licensing authority (such as FCC Part 97 in the United States) and all other applicable laws. This includes, without limitation, requirements for control operators, station identification, permitted content, and prohibitions on commercial use and encryption.

Unless its owner restricts access, a Node is presumed to be open for any properly licensed amateur radio operator to connect to and use, within the privileges of their license. Node owners who wish to limit access are responsible for configuring their own restrictions using the allow/deny database system described in the AllStarLink documentation. You must respect any access restrictions a Node owner has put in place and must not attempt to bypass them. This applies equally to connections made through third-party applications that access the AllStarLink network, or through any other AllStarLink tool.

5. Nodes and Node Numbers

  • Node Numbers are assigned by AllStarLink and remain the property of AllStarLink. A Node Number is assigned for your use only and may not be sold, transferred, or assigned to another person without our approval.
  • AllStarLink may limit the number of Node Numbers assigned to any Account.
  • A Node Number that has not registered with the AllStarLink network for two (2) years may be reclaimed and reassigned. AllStarLink administrators may also reclaim, suspend, or reassign any Node Number at their discretion, including for violations of these Terms.
  • You are responsible for the security and operation of your Nodes, including keeping software reasonably up to date and protecting Node credentials.
  • Node information, including Callsigns, Node Numbers, IP addresses, ports, and the descriptions and locations you provide, is published in public directories and lookup services as described in our Privacy Policy. This publication is necessary for the network to operate.

6. Acceptable Use

You agree not to:

  • use the AllStarLink Services for any unlawful purpose or in violation of these Terms;
  • submit false or fraudulent registrations, spoof Node registrations, or misrepresent your identity or Callsign;
  • share Account or Node credentials, or access Accounts, Nodes, or systems you are not authorized to use;
  • interfere with, overload, or disrupt the AllStarLink Services, including through excessive automated requests to our websites, APIs, or network services beyond what normal Node operation requires;
  • attempt to probe, scan, or circumvent the security of the AllStarLink Services;
  • upload or transmit malware or other harmful code;
  • harvest email addresses or other personal information from the AllStarLink Services, or send unsolicited advertising or spam to other users; or
  • post or transmit content that is unlawful, defamatory, harassing, threatening, obscene, or infringes the rights of others.

Automated access for ordinary Node operation, and reasonable use of published directories, node lists, and APIs, is permitted.

7. Community Services and User Content

Use of the community forum, mailing lists, and Helpdesk is subject to these Terms and to any community guidelines or forum rules that AllStarLink publishes, which become part of these Terms when posted.

User Content must be posted under your Callsign or, if you are unlicensed, under your first and last name as described in Section 3. You are responsible for your User Content and for your interactions with other users. You keep ownership of your User Content. By submitting it, you grant AllStarLink a non-exclusive, royalty-free, worldwide, perpetual license to host, store, display, reproduce, and distribute it as needed to operate and provide the AllStarLink Services. Forum posts may remain visible after your Account is closed.

AllStarLink may, but is not obligated to, monitor, edit, move, or remove User Content, and to restrict or suspend access to community services, at its discretion. AllStarLink is not responsible for disputes between users.

8. Intellectual Property

Website content. Unless otherwise specified, content on the AllStarLink websites is licensed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0). You may share and adapt it for any purpose, provided you give appropriate credit to AllStarLink, indicate if changes were made, and distribute your contributions under the same license. This license does not apply to the AllStarLink name and logo, User Content, or third-party material, which remain subject to their own terms. Linking to our websites is welcome.

Software. AllStarLink software is distributed under its own open-source license. Your rights to use, modify, and redistribute the software are governed by that license, and nothing in these Terms limits them.

Trademarks. “AllStarLink” and the AllStarLink logo are trademarks of AllStarLink, Inc. You may use them to refer to AllStarLink accurately, but not in a way that suggests endorsement or affiliation without our written permission.

9. Copyright Complaints (DMCA)

AllStarLink respects the intellectual property rights of others and will terminate the Accounts of repeat infringers in appropriate circumstances. If you believe material on the AllStarLink Services infringes your copyright, send a notice to our designated agent containing:

  1. a physical or electronic signature of a person authorized to act on behalf of the copyright owner;
  2. identification of the copyrighted work claimed to be infringed;
  3. identification of the allegedly infringing material and information reasonably sufficient for us to locate it;
  4. your address, telephone number, and email address;
  5. a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

10. Donations

Donations to AllStarLink are voluntary and are processed by our third-party payment provider, Donorbox. Donations are non-refundable except as required by law or at AllStarLink's discretion, and do not purchase any goods, services, or priority of service.

11. Suspension and Termination

AllStarLink may suspend or terminate your Account, reclaim your Node Numbers, remove your Nodes from directories, or restrict your access to any AllStarLink Service, with or without notice, if you violate these Terms or if we believe it is necessary to protect the network, other users, or AllStarLink. Fraudulent, abusive, or illegal activity may be reported to the appropriate authorities, including licensing authorities.

Notwithstanding the above, we reserve the right, in our sole discretion, to modify, suspend, or terminate your access to our website or service at any time, for any reason or no reason, without prior notice or liability to you.

Upon termination, your right to use the Service will immediately cease.

You may close your Account at any time by contacting helpdesk@allstarlink.org. Sections 7 through 9 and 12 through 16 survive any termination.

12. Service Availability

The AllStarLink Services are operated largely by volunteers. We may change, suspend, or discontinue any part of the AllStarLink Services at any time, and we do not guarantee that they will be available, uninterrupted, or error-free.

13. Disclaimer of Warranties

THE ALLSTARLINK SERVICES, INCLUDING ALL SOFTWARE, CONTENT, AND NETWORK SERVICES, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. ALLSTARLINK DOES NOT WARRANT THAT THE ALLSTARLINK SERVICES WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALLSTARLINK AND ITS OFFICERS, DIRECTORS, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, EQUIPMENT, OR USE, ARISING OUT OF OR RELATING TO THE ALLSTARLINK SERVICES OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALLSTARLINK'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE ALLSTARLINK SERVICES OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Indemnity

You agree to defend, indemnify, and hold harmless AllStarLink and its officers, directors, volunteers, and agents from any claims, liabilities, damages, and expenses, including reasonable legal fees, arising out of your use of the AllStarLink Services, your Nodes, your User Content, or your violation of these Terms or of any law or license condition.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the AllStarLink Services must be brought exclusively in the state courts located in Flagler County, Florida, or the United States District Court for the Middle District of Florida, and you consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in small claims court where it qualifies.

The AllStarLink Services are operated from the United States. If you use them from elsewhere, you are responsible for complying with your local laws.

17. Changes to These Terms

We may update these Terms from time to time. We will post updated Terms on this page with a new effective date and, for material changes, give reasonable advance notice on our website or by email. Your continued use of the AllStarLink Services after the changes take effect means you accept them.

18. General

These Terms, together with the Privacy Policy and any guidelines referenced above, are the entire agreement between you and AllStarLink regarding the AllStarLink Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the AllStarLink Services. Other agreements you may have with AllStarLink remain separate and are not changed by these Terms.
